CU, CUF, TPC File Amicus Brief in Watson v. RNC (Mail-In Voting)
On Tuesday, February 17, Citizens United, joined by Citizens United Foundation, The Presidential Coalition and others, filed an amicus curiae brief with the U.S. Supreme Court In Watson v. Republican National Committee urging the Court to affirm a 5th Circuit U.S. Court of Appeals ruling that a Mississippi law that extends the time for receiving mailed-in ballots to 5 days after election day violates the federal statutes setting “election day” as “the Tuesday next after the first Monday in November.” The brief makes three arguments: (1) the text of the election day statutes establishes a singular election day, (2) Congress established one election day to address voter fraud, and (3) The Constitution plainly authorizes Congress to override the time for holding a federal election, which the states may not violate. The brief’s overarching contention is: “The federal election-day statutes were established by Congress to limit voting to a single day across the nation in order to minimize fraud, and thus are of the highest order of importance, and must be given full effect by this Court.”
