Citizens United, Citizens United Foundation & The Presidential Coalition file Amicus Brief in McLinko v. Commonwealth
On February 25, 2022, Citizens United, Citizens United Foundation, and The Presidential Coalition filed with the Pennsylvania Supreme Court an amicus brief stating that the en banc Pennsylvania Commonwealth Court correctly struck down Act 77, Pennsylvania’s no-excuse absentee voting law. Specifically, the brief argues that the Commonwealth Court’s decision should be upheld as it is based on a proper construction, interpretation, and application of Article VII, Section 14 of the Pennsylvania Constitution. The argument is confirmed by (i) the provision’s text; (ii) its legislative history; and (iii) the interpretive maxim expressio unius est exclusio alterius.
