CU, CUF and TPC File Amicus Brief in U.S. v. Texas
In United States of American v. State of Texas, The Presidential Coalition and its co-amici urge the 5th Circuit U.S. Court of Appeals to allow a Texas law that criminalizes illegal entry into Texas across its southern border with Mexico to take effect. The Presidential Coalition argues that Texas and its sister states, as an attribute of sovereignty, share with the Federal government the inherent power to exclude illegal aliens from its territory. The Constitution’s Invasion Clause, as set forth in Article 1, Section 10, Clause 3, confirms that the states’ right of self-defense against invasion is a power reserved to the states, and that what is currently transpiring at our nation’s southern border unquestionably qualifies as an “invasion” as that term was understood by the Framers of the Constitution.
