Texas v. United States (CU Amicus Brief – DACA)
Citizens United, Citizens United Foundation, and The Presidential Coalition filed an amicus brief in the 5th Circuit on Monday, February 14. The brief supports the plaintiff states’ arguments that (a) Obama’s DHS did not have the statutory authority to adopt DACA; (b) it violates the separation of powers principle; (c) it is not an appropriate exercise of prosecutorial discretion; and (d) it violates the President’s duty to take care that the immigration laws be enforced.
